Welcome to Kala for Vidya, the online art fundraiser by the Rotary Club of Bangalore (RCB). By using this portal and purchasing an artwork, you agree to the following terms and policies.

1. Fundraising Nature

• All proceeds support Rotary’s charitable initiatives.
• RCB acts only as a facilitator for the sale; the creators (artists, sculptors, printmakers) remain responsible for their artworks.

2. Authenticity

• RCB does not independently verify the authenticity, originality, or provenance of artworks. Purchases are made solely on the creator’s declaration of authorship.
• RCB shall not entertain authenticity-related disputes once an order is placed.

3. Availability

• Some artworks may not be physically with RCB at the time of purchase. In such cases, the creator has assured delivery.
• If a creator fails to deliver, RCB’s sole liability is to refund the payment received. No further claims will be entertained.

4. Pricing & Taxes

• Prices are in Indian Rupees and include 5% GST.
• A GST invoice will be issued only if GST details (GSTIN, entity name, address) are provided at checkout. Post-payment GST invoices cannot be issued.

5. No Cancellation or Returns

• All sales are final.
• Once placed, orders cannot be cancelled, modified, or refunded.
• The only exception: if a creator fails to deliver the artwork, RCB will refund the full payment to the buyer.

6. Shipping & Delivery Policy

• Self-Collection: Free pickup from Rotary House of Friendship, Lavelle Road, Bengaluru, during office hours (Mon–Sat, 11 AM – 5 PM IST) by prior appointment. Collection must be done within 7 business days of confirmation.
• Within Bengaluru: Delivery available at a nominal charge (₹500–₹1,000 depending on size/weight).
• Outside Bengaluru: Buyers must arrange and pay for their own courier/logistics provider. RCB will pack the order (as is) and hand over to the designated courier.
• Sculptures & Heavy Works: May attract additional handling costs; buyers may need to arrange custom transport.
• Insurance: Shipping is uninsured by default. Buyers may request insurance at their own cost. RCB is not responsible for any damage during shipping.
• Timelines: Delivery timelines vary depending on location, courier availability, and creator submission.
• Tracking: Once shipped, buyers receive a tracking ID. RCB is not liable for courier delays, customs issues, or events beyond its control.

7. Liability

• RCB’s liability is strictly limited to the purchase price paid.
• RCB is not responsible for delays, damages, loss in transit, or dissatisfaction with the purchase.

8. Force Majeure

• RCB will not be liable for delays or failure to perform obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, courier delays, accidents, government restrictions, or pandemics.

9. Indemnity

• Buyers agree to indemnify and hold harmless RCB from any claims, damages, or expenses arising from misuse of the website, violation of these terms, or infringement of third-party rights.

10. Website Usage

• Users agree not to misuse the website (e.g., hacking, fraudulent orders, malware).
• RCB reserves the right to refuse service or cancel orders suspected of fraud.

11. Intellectual Property

• All website content (artwork images, designs, text) is the property of RCB.
• Use of images or content without prior written permission is strictly prohibited.

12. Privacy Policy

• Information Collected: At checkout, we collect your name, contact details, shipping address, and payment information. If you request a GST invoice, we also collect GST registration details.
• Use of Information: Data is used only for order processing, invoicing, statutory compliance, and delivery coordination.
• Data Sharing: We do not sell or share your personal data with third parties, except with payment gateways, courier partners, or creators (where necessary to fulfill your order).
• Security: All payments are processed securely through our authorised payment gateway. RCB does not store credit/debit card details.

13. Dispute Resolution

• All disputes shall be governed by Indian law and subject to the exclusive jurisdiction of Bengaluru, Karnataka courts.

14. Modification of Terms

• RCB reserves the right to amend these terms at any time without prior notice. Updated terms will be published on the website and apply prospectively.
